The animals ALWAYS come first. We may encounter the species you've been dreaming to see, but if the animal shows signs of distress or disinterest, we will prioritise their welfare. This could be due to others harassing the animals or too many boats, which is out of our control - we try to go to areas with less boats (which sometimes is unavoidable). BAJA WILD ENCOUNTERS - WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT PLEASE READ CAREFULLY IN FULL BEFORE SIGNING. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. 1. ASSUMPTION OF RISKS I understand and acknowledge that participating in tours with Baja Wild Encounters involves inherent risks, including but not limited to: • Drowning, injury from marine life, slips, falls, or collisions • Weather-related hazards, sun exposure, dehydration • Equipment malfunction or misuse • Limited access to medical facilities or emergency services • Remote locations with minimal infrastructure I voluntarily assume full responsibility for any and all risks associated with participation in any Baja Wild Encounters activity. 2. SCOPE OF COVERAGE This waiver applies to any and all activities offered by Baja Wild Encounters, including but not limited to: • Snorkeling • Open water swimming • Scuba diving • Whale watching • Hiking • Beach visits • Wildlife viewing • Boat tours • Any other activity offered, guided, or organized by the company This waiver is valid from the date of signing forward, for all future tours and activities unless revoked in writing. 3. DISCLAIMER REGARDING INSURANCE Baja Wild Encounters operates in natural and remote areas where commercial participant insurance is not currently available. As such, the company does not carry insurance coverage for guests. All participants are strongly encouraged to carry personal travel or medical insurance that includes adventure and marine activities. WAIVER OF LIABILITY & RELEASE OF CLAIMS In consideration of being permitted to participate in activities with Baja Wild Encounters, I agree to: • Release, waive, discharge, and hold harmless Baja Wild Encounters, its owners, employees, guides, contractors, affiliates, and partners from any and all liability, claims, demands, or causes of action arising out of or related to any injury, damage, or loss I may suffer, including those caused by ordinary negligence. This waiver does not exempt the company from liability resulting from gross negligence or intentional misconduct, which cannot be waived under law. 5. INDEMNITY I agree to indemnify and hold harmless Baja Wild Encounters and its personnel from any loss, liability, damage, or costs incurred due to my participation in activities. 6. MEDICAL CONDITIONS AND DISCLOSURES I confirm that: • I am in good physical condition and capable of participating in the activity. • I have disclosed all relevant medical conditions, allergies, and dietary restrictions. • I understand that failure to disclose such information releases Baja Wild Encounters from any responsibility related to those undisclosed conditions. 7. LIFE JACKETS AND SAFETY I understand that life jackets are present on board for safety, but are not required to be worn during the activity. I accept full responsibility for choosing whether or not to wear a life jacket. I also agree to follow all safety instructions provided by guides and staff. 8. PHOTOGRAPHY RELEASE I grant Baja Wild Encounters permission to use photos or videos taken during the activity for promotional purposes. To opt out, please inform your guide before the tour. 9. GOVERNING LAW This waiver shall be governed by the laws of Mexico, and if any provision is found invalid, the rest shall remain enforceable. 10. PARTICIPATION REQUIREMENT I understand that signing this waiver is a mandatory condition of participation. I may be refused entry to any activity if I do not complete this waiver in advance, and I acknowledge that no refund will be issued in such cases.
