We pride ourselves on offering authentic experiences off the beaten track, which sometimes involves visiting smaller local areas with limited infrastructure. This can occasionally result in unforeseen challenges, requiring itinerary changes. If, due to circumstances beyond our control, there are delays or an activity was inaccessible, how would you handle the situation?

BAJA WILD ENCOUNTERS - WAIVER OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT
Please read this document carefully before signing.
1. ACKNOWLEDGEMENT & ACCEPTANCE OF RISKS:
I am fully aware that participation in BAJA WILD ENCOUNTERS activities, including chartering, snorkeling, diving, and any activities, exposes me to inherent risks. These risks include, but are not limited to, equipment malfunction, sea hazards, unpredictable weather, and actions of other participants. I understand and willingly assume all such risks, both known and unknown.
2. VOLUNTARY PARTICIPATION:
My decision to participate in BAJA WILD ENCOUNTERS activities is made voluntarily. I recognize the potential dangers, including potential harm to personal property, personal injury, or even death.
3. DUTY OF CARE:
I understand that I have a personal duty to exercise care for my own safety and well-being during BAJA WILD ENCOUNTERS activities.
4. MEDICAL & RESCUE:
I recognize that BAJA WILD ENCOUNTERS operates in locations with limited medical facilities. I understand that in the event of a medical emergency, there may be delays in receiving medical care. While BAJA WILD ENCOUNTERS will make every effort to ensure safety, I understand that they have not promised specific rescue or first aid capabilities. However, if assistance is needed, I will not hold BAJA WILD ENCOUNTERS or its staff responsible for their actions or decisions during rescue or first aid situations.
5. RELEASE AND INDEMNIFICATION:
I, on behalf of myself and my heirs, hereby release and hold harmless BAJA WILD ENCOUNTERS, its employees, agents, and affiliates from any claims, liabilities, or lawsuits arising from my participation. This includes any claims which allege negligent acts or omissions of BAJA WILD ENCOUNTERS.
6. UNDERSTANDING & AGREEMENT:
By signing this document, I acknowledge that I have read, understood, and agreed to its terms. I understand that this waiver is intended to be as broad and inclusive as permitted by the laws of the jurisdiction in which the activities take place.
